1. Acceptance of Terms
By accessing or using SigStick ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and Accounts
You must be at least 13 years old to use the Service. If you create an account, you are responsible for all activities under your account and must keep your login credentials secure. If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian's permission to use the Service.
3. User Content
You are solely responsible for any content you upload, submit, or share via the Service. You must ensure that you have all necessary rights, licenses, consents, and permissions to use and distribute such content. You retain ownership of your content but grant us a license as described below.
4. Prohibited Content and Activities
You may not upload, post, or share content that:
- Violates any applicable law or regulation
- Infringes the intellectual property rights of others
- Contains hate speech, harassment, or threats
- Is sexually explicit or pornographic
- Promotes violence or illegal activity
Additionally, you may not:
- Access or use the Service in any manner that could damage or overburden our servers
- Reverse-engineer or attempt to derive the source code of the Service
- Use bots or automated systems to scrape or interact with the platform
5. Copyright Infringement & DMCA
We comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyright-protected work has been posted without authorization, please follow our DMCA takedown process.
We have a policy to disable or terminate accounts of users who are determined to be repeat infringers, in accordance with applicable law.
6. License Grant
By uploading content to the Service, you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, distribute, display, and perform your content in connection with operating and providing the Service.
7. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice. You may also delete your account at any time.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free.
9. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, arising out of or in connection with your use of the Service.
10. Dispute Resolution
Any disputes arising from or relating to these Terms or the Service will be resolved through binding arbitration in Vancouver, British Columbia, Canada, under the rules of the British Columbia International Commercial Arbitration Centre. Each party shall bear its own costs of arbitration.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of laws principles.
12. Changes to Terms
We may update these Terms from time to time. It is your responsibility to review the most current version of these Terms periodically. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
